Aber wie sieht es aus, wenn ihr einen Instagram-Account betreibt? In bestimmten F\u00e4llen braucht ihr auch auf der Social-Media-Plattform ein Impressum. Wir erkl\u00e4ren euch, wann eine Angabe eurer Daten n\u00f6tig ist und wie ihr es bei Instagram clever hinterlegt. Dieser Artikel soll Orientierung bieten, stellt jedoch keine Rechtsberatung dar. Bei Fragen zu rechtlichen Themen empfehlen wir, einen Rechtsexperten zu kontaktieren.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Impressum \u2013 was geh\u00f6rt unbedingt rein?<\/h2>\n\n\n\n<p>Was muss unbedingt in der Anbieterkennzeichnung einer Unternehmenswebsite stehen?<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Name und Adresse eures Unternehmens<\/li>\n\n\n\n<li>Eigent\u00fcmer eures Unternehmens<\/li>\n\n\n\n<li>Aktuelle Kontaktm\u00f6glichkeit<\/li>\n<\/ul>\n\n\n\n<p>Je nach Land, Branche oder anderen Faktoren sind zus\u00e4tzlich wom\u00f6glich weitere Informationen n\u00f6tig:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Name der rechtlich f\u00fcr die Seiteninhalte verantwortlichen Person (in der Regel ist das der\/die Gesch\u00e4ftsf\u00fchrer*in)<\/li>\n\n\n\n<li>&nbsp;Handelsregisternummer<\/li>\n\n\n\n<li>Steuernummer<\/li>\n\n\n\n<li>Das zust\u00e4ndige Amtsgericht<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Diese rechtlichen Vorgaben gibt es f\u00fcr ein Impressum bei Instagram<\/h2>\n\n\n\n<p>In Deutschland regelt das Telemediengesetz (TMG) die Impressumspflicht. Gesch\u00e4ftsm\u00e4\u00dfig betriebene Telemedien, also Websites, Blogs oder Social Media Accounts, m\u00fcssen ein Impressum besitzen. Dazu geh\u00f6rt demnach auch Instagram.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Wann brauche ich ein Impressum bei Instagram?<\/h3>\n\n\n\n<p>Habt ihr als Unternehmer*in mit Firmensitz in Deutschland einen Business Account bei Instagram, braucht ihr in jedem Fall einen Erscheinungsvermerk. Schlimmstenfalls k\u00f6nnen sonst Abmahnungen drohen. Diese werden oft von konkurrierenden Unternehmen oder Verbraucherschutzorganisationen verschickt und k\u00f6nnen hohe Geldstrafen zur Folge haben. Wenn ihr euren Insta-Account ausschlie\u00dflich privat nutzt, ben\u00f6tigt ihr in der Regel kein Impressum.<\/p>\n\n\n\n<p>Wie sieht es aus, wenn ihr Influencer seid, das hei\u00dft auf eurem Privataccount Werbeanzeigen schaltet oder Produkte mit dem Ziel bewerbt, Geld einzunehmen? Hier gilt der Grundsatz der Gesch\u00e4ftsm\u00e4\u00dfigkeit. Ma\u00dfgeblich ist nicht, ob ihr mit eurem Account tats\u00e4chlich Umsatz macht oder Gewinne erzielen m\u00f6chtet, sondern ob f\u00fcr kommerzielle Inhalte eures Accounts in der Regel Geld verlangt wird. Selbst wenn ihr noch ganz am Anfang eurer Influencer-Karriere steht und bald euren ersten Werbepost anpeilt, entbindet euch das nicht von der Impressumspflicht.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Wie setze ich die Impressumspflicht bei Instagram um?<\/h3>\n\n\n\n<p>Laut \u00a7 5, Absatz 1 des Telemediengesetzes muss das Impressum <strong>leicht erkennbar, unmittelbar erreichbar und st\u00e4ndig verf\u00fcgbar<\/strong> sein. Bei Instagram st\u00f6\u00dft man da als User schnell an seine Grenzen. Da das soziale Netzwerk in den USA ans\u00e4ssig ist und dort keine gesetzliche Impressumspflicht besteht, sucht ihr auf der Plattform vermutlich vergeblich ein Feld, wo ihr eure Daten eingeben k\u00f6nnt.<\/p>\n\n\n\n<p>Erschwerend kommt die im Gesetz vorgeschriebene unmittelbare Erreichbarkeit des Impressums hinzu, die sich in der Rechtsprechung als Zwei-Klick-Regel durchgesetzt hat. Das hei\u00dft: User d\u00fcrfen nicht mehr als zwei Klicks ben\u00f6tigen, um zur Herkunftsangabe zu gelangen. Wie k\u00f6nnt ihr das umsetzen, wenn der einzige vorgesehene Link bei Instagram in der Biografie ist? Keine Panik! Welche Optionen es gibt, trotzdem ein Impressum auf Instagram zu platzieren, erkl\u00e4ren wir euch im n\u00e4chsten Absatz. &nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Welche Optionen habe ich, ein Impressum in mein Profil bei Instagram zu integrieren?<\/h2>\n\n\n\n<p>Die naheliegendste Option ist, euer Impressum auf Instagram in die Biografie zu integrieren (also oben in eurem Profil). Hier k\u00f6nntet ihr einen Link zu eurer Website einf\u00fcgen, auf der die Nutzer*innen euer Impressum vorfinden \u2013 theoretisch. Denn einerseits m\u00f6chte niemand die 150 vorgesehenen Zeichen der Biografie verschenken \u2013 diese geh\u00f6ren euch und der Vorstellung eures Unternehmens \u2013, andererseits bietet Instagram nicht die M\u00f6glichkeit, den Bio-Link klickbar zu machen, womit dieser nicht rechtskonform w\u00e4re.<\/p>\n\n\n\n<p>Eine Alternative ist, den Link in das Feld Website zu integrieren. Vorteil: Der Link ist direkt klickbar und entspricht damit den Anforderungen von \u00a7 5 Abs. 1 des Telemediengesetzes, leicht auffindbar, also mit zwei Klicks erreichbar zu sein. Der Nachteil: User landen nicht direkt auf der Hauptseite eurer Website, sondern eben zuerst auf dem Impressum, was in puncto Instagram-Marketing nicht so attraktiv ist.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Zwei Optionen, wie ihr euer Impressum schnell und smart bei Instagram unterbringt<\/h3>\n\n\n\n<p>Da beide oben genannten M\u00f6glichkeiten nicht wirklich praktikabel sind, haben sich auf Instagram folgende Optionen durchgesetzt:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Weiterleitungslink: Ihr richtet im Feld Website eine Umleitungs-URL ein, die den Begriff Impressum enth\u00e4lt. An dieser Stelle k\u00f6nnt ihr gleich noch auf eure Datenschutzerkl\u00e4rung verlinken. Sie sollte einen Hinweis enthalten, wie personenbezogene Daten von Besucher*innen eures Instagram-Profils auf der Social-Media-Plattform verarbeitet werden. So schlagt ihr gleich zwei Fliegen mit einer Klappe. Der Umleitungslink f\u00fchrt jedoch nicht direkt auf die entsprechenden Angaben, sondern auf die Hauptseite eures Unternehmens, wo die User Impressum und Datenschutzerkl\u00e4rung ganz normal im Footer vorfinden k\u00f6nnen (damit habt ihr die Zwei-Klick-Regel umgesetzt und bewerbt gleichzeitig die Website eures Business).<\/li>\n\n\n\n<li>Ihr richtet eine Landingpage ein: Das kann eine Seite eurer Website sein, auf der User landen, wenn sie auf die URL im Feld Website klicken. Hier sammelt ihre alle wichtigen Links, auf die ihr die User aufmerksam machen wollt: Hauptseite, Impressum, Datenschutzerkl\u00e4rung und evtl. noch weitere. Am besten benennt ihr die Landingpage so, dass Nutzer*innen wissen, was sich hinter dem Link verbirgt. Zum Beispiel: unternehmenswebsite.de\/impressum-und-datenschutzerkl\u00e4rung<\/li>\n<\/ul>\n\n\n\n<p>Externe Anbieter*innen wie Linktree bieten Vorlagen, mit denen ihr diverse Website-Inhalte (Hauptseite, Impressum, Datenschutzerkl\u00e4rung usw.) als Linkbaum hinterlegen und sie \u00fcber einen zentralen Link erreichbar machen k\u00f6nnt. Datenschutzrechtlich ist diese Variante allerdings fragw\u00fcrdig, da bei solchen Drittanbieter*innen unklar ist, ob sie Analyse- und Tracking Tools verwenden (auf die ihr die User wiederum in eurer Datenschutzerkl\u00e4rung aufmerksam machen m\u00fcsstet). Ihr seid auf der sicheren Seite, wenn ihr eure Datenangabe selbst erstellt.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Fazit: So geht ihr mit der Impressumspflicht bei Instagram um<\/h2>\n\n\n\n<p>Wenn ihr einen Business Account auf Instagram habt oder euren Privataccount gewerblich nutzt, kommt ihr um ein Impressum nicht herum. Da am Firmensitz von Instagram in den USA keine Impressumspflicht gilt, gibt es auf der Plattform bisher noch keine vorgesehene Rubrik daf\u00fcr. Damit entf\u00e4llt die M\u00f6glichkeit, die entsprechenden Angaben als Text einzugeben. Behelfen k\u00f6nnt ihr euch mit einer Umleitungs-URL oder einer Landingpage, deren Link ihr im Feld Website platziert.
